I support coal ash disposal regulations that protect human health and the environment while encouraging greater recycling of coal ash. These goals cannot both be accomplished if the Environmental Protection Agency designates coal ash a hazardous "special waste." People will not want a material in their homes, schools and neighborhoods if it is considered hazardous in a landfill. Businesses will not want to risk being sued for using a material that is considered hazardous in a landfill. We risk losing the environmental benefits that come with recycling millions of tons of this material - including conserving landfill space and natural resources, as well as avoiding the emissions of millions of tons of greenhouse gases from manufacturing the materials recycled coal ash replaces. There is no good reason to risk destroying coal ash recycling. EPA's own proposed rule acknowledges that landfill engineering standards would be essentially the same whether coal ash is labeled hazardous or not. Furthermore, new landfill standards actually would be put in place faster if the hazardous label is not pursued. EPA can and should enact new regulations while encouraging the safe recycling of coal ash as a preferred alternative to disposal. To do so, EPA must NOT designate coal ash as a hazardous "special waste."
